In Forbes v Wokingham BC (QBD (Admin)), the Council successfully defended a challenge to its decision to refuse to register land as a new town or village green.
The claimant raised four grounds of challenge, with the judge dismissing the first and rejecting the other three. On the first ground Vice President of the Upper Tribunal Mr Ockelton ruled “there is no statutory procedure for the determination for an application of this sort”, therefore it followed the Council was entitled to adopt what it thought was appropriate.
